TERMS & CONDITIONS OF SALE
1 The highest bidder shall be the buyer subject to the vendor's approval and reserve price, if any.
2 Time shall be the essence of the sale of any lot.
3 The Auctioneer may without giving any reason, refuse to accept any bid or offer for any lot or withdraw any lot from sale.
4 A bid shall be deemed to be accepted unless the auctioneer forthwith after it has been made declares his non-acceptance or dissent.
5 Should any dispute arise regarding any lot that lot may be at the option of the auctioneer put up again and resold or withdrawn and the Auctioneer's decision shall be final.
6 All lots having been available for inspection are sold "as is where is" and no allowance or refunds will be made, nor will any buyer be permitted to reject any lot on the grounds that it is not correctly described in any advertisement, catalogue or invoice and the said lots are to be taken with all faults, if any, and will be at the buyer's risk on the fall of the hammer and thereafter the vendor will be free from all responsibility for safe-guarding the goods and will not be liable for any loss or damage of the goods sold whether such loss or damage is caused or contributed to by any act, neglect or default of the vendor, its servants, employees or agents.
7 Where an exact quantity is nominated and any discrepancy arises between the quantity of goods described at the time of sale and that actually available at the time of delivery the buyer shall take and the Auctioneer shall be required to effect delivery of only the quantity actually so available. No compensation will be paid in respect of any such deficiency. However, the buyer may claim a pro-rata adjustment of the purchase price. No adjustment will be made unless the buyer makes his claim at or before the time of delivery.
8 Each buyer shall complete a buyer's card and shall, if required, pay a deposit of not less than 20% of the purchase price on the fall of the hammer.
9 All payments including deposits shall be made by cash, certified bank cheque, credit cards(Mastercard, Visa and Bankcard only) or direct deposit into AuctionsRus Trust Account.
10 The balance of the purchase price shall be paid and the goods collected by the buyer at the buyer's expense no later than 12.00pm on the day following the sale.
11 Any goods not paid for and collected on time will be treated as abandoned and may be resold by the Auctioneers.
12 No goods are to be removed without the presence of a member of AuctionsRus staff.
13 Upon the buyer failing to comply with any of the above conditions all monies received in part payment shall be absolutely forfeited and all lots uncleared may be resold by public auction or private contract and the deficiency, if any, on such resale together with all costs and charges attending shall be made good by the defaulter at the sale.
14 A right to bid for and on behalf of the vendor is expressly reserved.
15 Notice is given that all electrical items are sold in a used condition and no warranty is given that their present state complies with the requirements of the relevant state body and all goods should be checked by a registered electrical contrator before use or resale.
16 GST of 10% is included in the knock-down price of each lot.
17 A buyer's premium of 15%(inc GST) applies to this sale.
18 No vendor, its servants, employees or agent of the company are authorised to waive, add to or vary these conditions without the written authority of the company's General Manager. |
